1. Definitions

In these Terms, the following definitions apply:

• "Account" means the account created by a User to access and use the Services.
• "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.

• "Products" means the hardware components and other items offered for sale through the Services.
• "Services" means the PC upgrade, repair, and other technical services offered by PiratesWep.
• "Subscription" means a recurring Order for Products or Services at specified intervals.
• "User" means an individual who accesses or uses the Services.
• "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.

2. Account Registration and Use

2.1 Account Creation

To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

2.2 Age Requirement

You must be at least 18 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 18 years old.

2.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

2.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

3. Services and Products

3.1 Service Description

PiratesWep provides PC upgrade services, including but not limited to hardware installation, component replacement, system optimization, and custom PC building. The specific services offered may change from time to time at our discretion.

3.2 Product Availability

All products displayed on our website are subject to availability. We reserve the right to discontinue any product at any time. We are not responsible for any delays in delivery due to manufacturer shortages or issues outside our control.

3.3 Service Scheduling

After placing an order for our services, we will contact you to schedule an appointment. You agree to make your PC available at the agreed time. If you need to reschedule, please provide at least 24 hours' notice.

3.4 Service Location

Our services are provided at our service center, unless otherwise specified. For certain services, we may offer on-site service or pickup and delivery options for an additional fee.

4. Orders and Payment

4.1 Placing Orders

When you place an order through our website or other channels, you offer to purchase the products or services at the price and terms indicated. We reserve the right to accept or decline your order for any reason.

4.2 Pricing and Quotations

All prices displayed on our website are in Euros and include applicable taxes unless otherwise stated. For custom services, we will provide a quotation before beginning work. If additional issues are discovered during service that require additional parts or labor, we will notify you and obtain your approval before proceeding.

4.3 Payment Methods

We accept various payment methods as indicated on our website. By providing payment information, you represent and warrant that you have the legal right to use the payment method you have selected.

4.4 Deposits

For certain services, particularly custom builds or upgrades requiring specialty components, we may require a deposit before ordering parts or beginning work.

4.5 Late Payments

We reserve the right to charge interest on late payments at the rate of 2% per month or the maximum rate permitted by law, whichever is lower. You will be responsible for all reasonable expenses (including attorneys' fees) incurred by us in collecting late payments.

5. Warranties and Returns

5.1 Service Warranty

We warrant that our services will be performed in a professional and workmanlike manner. If you are not satisfied with our service, please contact us within 14 days, and we will work to resolve the issue at no additional cost.

5.2 Product Warranty

Products sold by us come with the manufacturer's warranty. We do not provide additional warranties on products unless specifically stated. For details on manufacturer warranties, please refer to the manufacturer's documentation.

5.3 Used or Refurbished Items

Used or refurbished items may come with a limited warranty as specified at the time of purchase.

5.4 Return Policy

6. User Responsibilities

6.1 Data Backup

You are solely responsible for backing up your data before we perform any services on your PC. While we take reasonable precautions to protect your data, we are not responsible for any data loss that may occur during service.

6.2 Software Licenses

You must ensure that all software on your PC is legally licensed. We reserve the right to refuse service if we reasonably believe that your PC contains illegally copied software.

6.3 Accurate Information

You agree to provide accurate and complete information about your PC and the issues you are experiencing. If you provide misleading information that causes us to perform unnecessary work, additional charges may apply.

6.4 Timely Pickup

You agree to pick up your PC within 14 days of being notified that service is complete. If you fail to pick up your PC within 30 days, we reserve the right to assess storage fees or dispose of the PC according to applicable laws.

7. Intellectual Property

7.1 Our Intellectual Property

The content on our website, including but not limited to text, graphics, logos, images, and software, is the property of PiratesWep or its content suppliers and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from this content without our express written permission.

7.2 Trademarks

PiratesWep and all related logos, product and service names, designs, and slogans are trademarks of PiratesWep or its affiliates. You may not use these marks without our prior written permission.

7.3 User Content

By submitting content to our website (such as reviews, comments, or testimonials), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

8. Limitation of Liability

8.1 Service Performance

While we strive to provide the best possible service, we cannot guarantee that our services will meet your specific requirements or expectations. We are not responsible for any losses or damages resulting from the use of our services.

8.2 Maximum Liability

In no event shall PiratesWep, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services; and
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us for services in the 12 months preceding the claim.

8.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless PiratesWep, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Services' content, services, and products other than as expressly authorized in these Terms.

10. Dispute Resolution

10.1 Informal Resolution

Before filing a claim against PiratesWep, you agree to attempt to resolve the dispute informally by contacting us. We will attempt to resolve the dispute informally by contacting you via email. If the dispute is not resolved within 60 days of submission, you or PiratesWep may proceed to formal dispute resolution.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

10.3 Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Poland, and you hereby consent to the personal jurisdiction and venue therein.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website and updating the "Last Updated" date at the top of this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PiratesWep regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and PiratesWep.
